TERMS OF SERVICE

The terms "we," "us," and "our" refer to Gellerholz Inc. ("Company").

The term "Site" refers to www.wayfindercollection.com ("Site"). On the Site, we sell fine art prints and framed artwork ("Products") (collectively, "Services").

The term "user," "customer," "you," and "your" refers to visitors, users and customers of the Site and/or Services.

By using our Site and/or Services, you are agreeing to the following Terms of Service, our Privacy Policy and any other agreement that governs your use of our Site or Service (collectively, "Agreements"). Do not use our Site or Services if you do not agree with the terms and conditions contained in these Agreements.

1. COMPANY'S PRODUCTS AND SERVICES

The Company sells fine art photography prints and framed artwork. All Products are custom-made to order. Product descriptions, images, and specifications on our Site are for informational purposes. While we strive for accuracy, colors may vary slightly due to different monitor settings and printing processes.

2. USE OF THE SITE OR SERVICES

2.1 LAWFUL PURPOSES. You may use the Site and/or Services for lawful and legitimate purposes only. To access or use the Site and/or Services, you must be eighteen (18) years or older and have the requisite power and authority to enter into these Terms of Service. Minors are prohibited from using the Site and/or Services.

2.2 ACCOUNT INFORMATION. In order to purchase Products, you may be required to provide information about yourself including, but not limited to, your name, email address, shipping address, and payment information (collectively, "Account Information"). You agree that any Account Information you provide will always be accurate, correct and up to date. You must not impersonate someone else or provide information other than your own. You are solely responsible for maintaining the confidentiality of your Account Information.

2.3 CONSENT. When you register with the Company or make a purchase, you expressly consent to receive notices, order confirmations, shipping updates, and other communications from the Company electronically by way of email.

2.4 REFUSAL OF SERVICES. We reserve the right to refuse service or cancel orders, without refund or liability, if in our sole discretion, you violate these Terms of Service or other Agreements governing your use of the Site and/or Services.

3. PAYMENTS AND REFUNDS

3.1 PRICING. All prices for our Products are as set forth on the Site and are payable in United States dollars. You agree to be financially responsible for all purchases made by you at the prices stated at the time of your purchase, as well as any applicable sales tax. We reserve the right to modify our pricing at any time without advance notice.

3.2 FORM OF PAYMENT. Payment may only be made with a valid credit card or debit card. Fees will be processed through third-party payment processing systems (Shopify Payments or similar). By using any such card or payment provider, you are representing and warranting your full right and authority to make such purchase.

3.3 CUSTOM ORDERS AND REFUNDS. Because all Products are custom-made to order specifically for you, we do not accept returns or offer refunds for change of preference. We will replace any Product that arrives damaged, defective, or incorrect at no charge to you within 30 days of delivery. Please see our Returns & Replacements policy for full details.

4. SHIPPING

4.1 SHIPPING TIMELINE. Products are custom-made to order and typically ship within 10 business days. Delivery times vary by location but most orders arrive within 10-12 business days of purchase.

4.2 SHIPPING LOCATIONS. We currently ship to addresses in the continental United States only. For inquiries about shipping to Hawaii, Alaska, or international destinations, please contact us at aloha@thehawaiivacationguide.com

4.3 RISK OF LOSS. All Products are shipped FOB shipping point. Risk of loss and title for Products passes to you upon delivery to the carrier.

5. PROHIBITED USES

You may use the Site and/or Services only for lawful purposes and in accordance with these Terms of Service. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
• Impersonate the Company, a Company employee, another user, or any other person or entity
• Use the Site in any manner that could disable, overburden, damage, or impair the Site
• Use any robot, spider, or other automatic device to access the Site for any purpose
• Introduce any viruses, trojan horses, worms, or other malicious code
• Take any action that may damage or falsify the Company or Site rating
• Otherwise attempt to interfere with the proper working of the Site

6. AFFILIATE LINKS

The Site may contain affiliate links to third-party websites or services. If you purchase an item or service through one of our affiliate links, we may earn a commission. Affiliate relationships will be disclosed where applicable.

7. THIRD PARTY RESOURCES

We may share links or referrals to third party websites, resources, or services ("Third Party Resources"). We make no representation or warranties regarding Third Party Resources. Your use of Third Party Resources is at your own risk and is subject to their terms and conditions.

8. DISCLAIMER

ANY PRODUCTS AND/OR INFORMATION PROVIDED ON THE SITE AND/OR SERVICES IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ACKNOWLEDGE THAT PRODUCTS MAY INCLUDE MINOR VARIATIONS IN COLOR OR printing due to monitor settings and printing processes. COMPANY MAKES NO WARRANTIES THAT YOUR USE OF THE SITE WILL NOT INFRINGE THE RIGHTS OF OTHERS.

9. LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, COMPANY AND ITS SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF COMPANY EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID TO COMPANY FOR THE PRODUCTS.

THE LIMITATIONS OF LIABILITY PROVIDED IN THESE TERMS INURE TO THE BENEFIT OF COMPANY. IF THE LAW OF THE COUNTRY WHERE YOU LIVE DOES NOT ALLOW ANY PARTICULAR LIMITATION OR EXCLUSION OF LIABILITY PROVIDED FOR IN THIS CLAUSE, THAT LIMITATION WILL NOT APPLY.

10. INTELLECTUAL PROPERTY

10.1 COMPANY'S INTELLECTUAL PROPERTY. All content on the Site, including photographs, artwork, text, graphics, logos, and the "look and feel" of the Site, are the intellectual property of the Company and are protected by copyright and other intellectual property laws. No right, title, or interest in any content is transferred to you.

10.2 LIMITED LICENSE. These Terms of Service permit you to view and order Products for your personal, non-commercial use only. You may not:

• Reproduce, modify, distribute, or create derivative works from any Products or Site content
• Delete or alter any copyright, trademark, or other proprietary rights notices
• Use any content for commercial purposes without prior written consent
• Use automated systems to access or copy any portion of the Site

10.3 TRADEMARKS. All trade names, trademarks, and images used on the Site, including The Wayfinder Collection name and logo, are the property of the Company. Unauthorized use is strictly prohibited.

11. CUSTOMER FEEDBACK AND REVIEWS

You agree that the Company has the right to use your feedback, reviews, testimonials, or comments about our Products for marketing purposes. We may use, disclose, reproduce, and distribute this feedback without compensation to you.

12. INDEMNIFICATION

You shall indemnify and hold the Company harmless from any losses, damages, liabilities, costs, and expenses, including attorneys' fees, arising out of (i) your breach of these Terms of Service; (ii) your violation of any law or the rights of a third-party; or (iii) your use of the Site and/or Services.

13. TERM

These Terms of Service remain in full force and effect while you use our Site and/or Services. All provisions shall survive termination, including terms relating to intellectual property, disclaimers, indemnification, and limitations of liability.

14. GOVERNING LAW

These Terms of Service shall be governed by the laws of the State of Virginia.

15. DISPUTE RESOLUTION

We agree to attempt to resolve any dispute by first trying to resolve it through good faith negotiation. If the dispute is not resolved within forty-five (45) days, any party may take the matter to court. If any court action is necessary to enforce these Terms of Service, the prevailing party will be entitled to reasonable attorney fees and costs.

16. ENTIRE AGREEMENT

These Agreements (this Terms of Service, Privacy Policy, and any other written agreement) constitute the entire agreement between you and the Company with respect to the Site and Services.

17. SEVERABILITY

If any provision of these Terms of Service is held invalid, the rest of the Terms shall remain in full force and effect.

18. CHANGED TERMS

We reserve the right to update these Terms of Service at any time. Amendments are effective immediately upon posting to the Site. Your continued use after amendments constitutes acceptance of the new terms.
